ORDINANCE NO. 04-19

AN ORDINANCE AUTHORIZING THE ACQUISITION OF

CERTAIN LANDS IN THE BOROUGH OF HILLSDALE,

COUNTY OF BERGEN, PURSUANT TO N.J.S.A.

40A:12-5 et seq.

WHEREAS, the Borough Council of the Borough of Hillsdale has determined that it is in the public interest to acquire lands hereinafter described, and further that acquisition of the property in fee simple title is necessary in the interest of land use planning.

NOW, THEREFORE, BE IT ORDAINED, by the Borough Council of the Borough of Hillsdale:

Section 1. That fee simple title in and to the following described parcels of real estate be and is hereby appropriated for the purpose and the Borough has hereby authorized the acquisition of the property for the authorized expenditure for the following sum of money in order to acquire fee simple title, to wit:

Lot: 9

Block: 1610

Address: 77 Ralph Avenue

Owner: Pascack Hills Properties LLC

Amount: $190,000.00

Section 2. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be unconstitutional or invalid, such decision shall not affect the remaining portions of this Ordinance.

Section 3. All Ordinances or any provisions of any ordinances inconsistent with the provisions of this Ordinance are hereby repealed as to such inconsistencies and not otherwise.

Section 4. This Ordinance shall become effective twenty (20) days after final passage and publication according to law.
