ORDINANCE NO. 05-22

 

               AN ORDINANCE AUTHORIZING THE ACQUISITION

               THROUGH DONATION OF CERTAIN LANDS IN THE

               BOROUGH OF HILLSDALE, COUNTY OF BERGEN,

               PURSUANT TO N.J.S.A.40A:12-5 et seq.

 

 

     BE IT ORDAINED, by the Mayor and Council of the Borough of Hillsdale that:

 

     WHEREAS, the Borough Council of the Borough of Hillsdale has determined that it is in the public interest to acquire lands hereinafter described, and further that acquisition of the property in fee simple title is necessary in the interest of land use planning;

 

     NOW, THEREFORE, BE IT ORDAINED, by the Borough Council of the Borough of Hillsdale:

 

     Section 1:  That fee simple title in and to the following described parcel of real estate be and is hereby appropriated for the purpose and the Borough has hereby authorized to accept through donation the property and has authorized the expenditure for the following sum of money in order to acquire fee simple title, to wit:

            Section 2:  If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be unconstitutional or invalid, such decision shall not affect the remaining portions of this Ordinance.

 

     Section 3:  All Ordinances or any provisions of any ordinances inconsistent with the provisions of this Ordinance are hereby repealed as to such inconsistencies and not otherwise.

 

     Section 4:  This Ordinance shall become effective upon final passage and publication according to law.
