ORDINANCE TO AMEND CHAPTER 230 RECORDS and Chapter 138 FEES OF THE CODE OF THE BOROUGH OF HILLSDALE TO AMEND THE PROCEDURES FOR REQUESTING RECORDS AND TO SET FEES THEREFORE

 

            SECTION 1.  Chapter 230-4 of the Code of the Borough of Hillsdale is amended to replace Section 230-4 as follows:

§ 230-4.  Borough action upon request.

Upon receipt of a request for records, if said records are public, the Borough will endeavor to respond to the request within 7 days of the receipt of said request. Working days are defined as Monday through Friday, excluding holidays.

            Section 2.  Chapter 230-7 of the Code of the Borough of Hillsdale is amended to replace Section 230-7 as follows:

§ 230-7.  Copying costs.  Shall be in payable in accordance with Statute and supplemented by the schedule in Chapter 138.

            SECTION 3.  Chapter 138 is amended to include the following:

Chapter 230 Records

All copying cost shall be established in accordance rates set by State laws and regulations supplemented as follows:

 

Copying (burning) Borough electronic files to disk                           $10.00

Copying Tape recorded Borough meetings to VHS tape                  $22.00

Copying recorded Borough meetings from VSH Tape to disk          $20.00

Electronic transfer of tax searches or property data weekly              $15.00 (per transfer)

Researching Records not readily available per hour                          $35.00 per hour

 

For purposes of this section not readily available shall mean requiring more than ten (10) minutes of employee time as the document or record is not kept in the form and compilation as requested.  The Borough reserves the right to refuse any request which would unduly burden the Borough personnel. 

 

SECTION 3.  Prior Inconsistent Ordinances Superseded.  All ordinances or parts of ordinances contrary to or inconsistent with this ordinance are hereby superseded.

 

            SECTION 4.  Invalidity.  If any section or provision of this Ordinance be adjudged invalid or unconstitutional, preempted by Federal or State law, or otherwise invalid by any court of competent jurisdiction, the same shall not affect the validity of the ordinance as a whole or any other section or provision hereof.

 

            SECTION 5.  Effect. This ordinance shall take effect immediately upon final passage and publication, or otherwise as provided by law.
