BOROUGH OF HILLSDALE

 

ORDINANCE NO. 08-08 

 

TO AMEND CHAPTER 220 ENTITLED “PARKS AND RECREATION AREAS”

 

 

WHEREAS, it is the desire of the Governing Body to protect the health, safety and welfare of all who use the public parks, playgrounds and open spaces of the Borough of Hillsdale;

 

NOW, THEREFORE BE IT ORDAINED, by the Governing Body of the Borough of Hillsdale in the County of Bergen and State of New Jersey as follows:

 

Section I.  Amend and Supplement

That Section 220-1 of the Code, which applies to the Hours of Operation of the public parks, playgrounds and open spaces of the Borough of Hillsdale, is hereby amended by the addition of the following language, immediately after Section 220-1 (B):

 

“C. For the purposes of this section, the activation of the Hillsdale Lightning Detection System constitutes a duly proclaimed emergency. Upon such activation, all public parks, playgrounds and open spaces of the Borough of Hillsdale are immediately closed and remain closed through the entire duration of the System activation. All groups and individuals using these areas must immediately stop their activities and exit for the purpose of seeking shelter. It is prohibited and unlawful to violate this section, and punishable under section 226 of the Borough Code.”

 

Section II.  Severability

If any section, subsection, paragraph, sentence, clause, phrase, or word contained in this ordinance shall be declared invalid for any reason whatsoever, such decision shall not affect the remaining portions of this ordinance, which shall remain in full force and effect and to this end the provisions of this ordinance are hereby declared to be severable.

 

Section III.  Repealer

All other ordinances of the Borough, or parts thereof, which are in conflict with this ordinance are hereby repealed to the extent of such conflict.

 

Section IV.  Effective Date

 

This ordinance shall take effect immediately after final passage, approval and publication of notice thereof, as required by law.
