                                Ordinance 09-09

                (Introduction)

 

An Ordinance to Amend Chapter 310-56B “Fences” and Chapter 310-55 “Regulations Applicable to all Districts” to Modify the Maximum height of fences in the Residential Zones and to modify the required setback of Sheds in the R3 and R4 zones

 

SECTION 1 Chapter 310-56B, Fences, of the Ordinances of the Borough of Hillsdale is replaced as follows:

 

  1. No fence in any residential district or on a lot in any other district on which residential buildings are erected shall exceed four feet in height above ground level when located at a distance closer to any street line than the front setback line prescribed for said district, nor shall any such fence exceed six feet in height above ground level when located at a distance equal to or greater than the front setback line prescribed for said district.

SECTION 2 Chapter 310-55 “Regulations Applicable to All Districts” is amended such that paragraph H 4 Accessory Structures and Uses is replaced as follows:

4.  Accessory Structures and Uses

a. An accessory structure other than a fence may be located in any required rear yard, provided that it is set back from all lot lines a distance not less than the height of such structure; provided however, that, in the case of a corner lot, it shall also conform

b. Notwithstanding section H 4 a above in the R-3 and R-4 zones only, any detached accessory structure with a maximum size of 100 SF and a maximum height of 8 ft. may have a 4 ft. setback from the rear and side property lines.  Any detached accessory structure that is larger in size than 100 SF or has a height in excess of 8 ft. must meet the setback requirements contained in 310-55H (4a).

 

SECTION 3: All ordinances and resolutions inconsistent with the provisions of this ordinance are hereby repealed as to such inconsistencies.

 

SECTION 4: This ordinance shall take effect immediately after final passage, approval and publication of notice thereof as required by law.
