RESOLUTION

WHEREAS, the Planning Board of the Borough of Hillsdale re-adopted a Master Plan dated February, 2003, revised through December 16, 2003; and
WHEREAS, the Master Plan in the Land Use Element made the following recommendation:
“The Borough Council should consider developing regulations that would permit offices as conditional uses for those properties fronting along or in direct contact with the Broadway right-of-way lines, between Cross Street and Knickerbocker Avenue. The conditions should include requiring detailing that an office must be residential in appearance with minimal parking to be in character with the existing residential dwellings. All dumpsters should be enclosed so that they are not visible to the adjacent properties. A new office building in the area should be of the size and bulk of the existing residential dwellings so that it ‘fits in’ with the neighborhood.”; and
WHEREAS, the Governing Body of the Borough of Hillsdale has considered this recommendation as well as hearing the comments, concerns and opinions of the residents in the area at open public meetings; and
WHEREAS, the Governing Body rejects the Broadway office use aspect of the Land Use Element of the Master Plan aforementioned; and
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Hillsdale, County of Bergen and State of New Jersey, hereby requests that the Planning Board of the Borough of Hillsdale reconsider that portion of the Land Use Plan Element of the Master Plan of the Borough of Hillsdale, Bergen County, New Jersey, dated February, 2003, revised through December 16, 2003, and eliminate its recommendation for the Council consideration for “Broadway office” uses above set forth; and be it
FURTHER RESOLVED that the Governing Body recognizes that the Municipal Land Use Act requires that the Zoning Ordinances shall either be substantially consistent with the Land Use Plan Element of the Master Plan, or designed to effectuate such Plan elements, unless the Governing Body adopts a Resolution indicating the inconsistency and the reasons for the Governing Body so acting. Such a Resolution must be recorded in the Minutes of the Governing Body; and be it
FURTHER RESOLVED that in the event the Planning Board does not reconsider and amend the Master Plan, the Governing body hereby makes the following findings as to why the Land Use Chapter of the code of the Borough of Hillsdale is inconsistent with the recommendation in the aforementioned readopted land use element of the Master Plan to permit offices along Broadway between Cross Street and Knickerbocker Avenue:
1. Offices and/or Home Offices represent a substantial departure from the residential family dwellings present in this R4 zone; and
2. The parking requirements associated with either Office and/or Home Office use will deleteriously impact the surrounding residential neighborhood as well as increase vehicular traffic in an already highly congested traffic area.
