RESOLUTION

Title: Authorizing application to Bergen County Trust Fund for

Acquisition of Three Properties; Block 908, Lot 16 (Pawn) ,

Block 909, Lot 7 (off Maria Drive) and Block 1111, Lots 1 & 2

(49 Lafayette and 6 Center)

 

WHEREAS, the Bergen County Open Space, Recreation, Farmland and Historic Preservation Trust Fund (“County”) provides grants to municipal governments and grants to nonprofit organizations for assistance in the acquisition and development of lands for outdoor recreation and conservation purposes; and

 

WHEREAS, the Borough of Hillsdale desires to further the public interest by obtaining a grant of $549,000 from the County to fund the following project:

 

Acquisition of Three Properties to Prevent Development in the Flood Hazard Area and Preserve These Parcels as Open Spaces.

NOW, THEREFORE, the governing body resolves that Christopher P. Statile, P.E. or the successor to the office of Borough Engineer is hereby authorized to:

 

(a)     make an application for such a grant

(b)    provide additional application information and furnish such documents as may be required

(c)     act as the authorized correspondent of the above named applicant; and

 

WHEREAS, the County shall determine if the application is complete and in conformance with the scope and intent of the Bergen County Trust Fund, and notify the applicant of the amount of the funding award; and

 

WHEREAS, the applicant is willing to use the county’s funds in accordance with such rules, regulations and applicable statutes, and is willing to enter into an agreement with the county for the above named project;

 

WHEREAS, the Borough of Hillsdale previously submitted two separate applications to the Bergen County Open Space Trust Fund, one for the acquisition of Block 909, Lot 7, and another for the acquisition of two properties identified as Block 908, Lot 16, and Block 1111, Lots 1 & 2; and

 

WHEREAS, the Bergen County Open Space Trust Fund believes all three properties are part of the Borough’s efforts to prevent development in flood prone areas and has therefore requested the Borough to replace the two previously submitted applications with one combined application;

 

NOW, THEREFORE, BE IT RESOLVED, that this resolution authorizes the submission of a single application for the three properties identified above to the Bergen County Open Space Trust Fund;

 

BE IT FURTHER RESOLVED, by the Borough Council of the Borough of Hillsdale that:

 

1.  That the Mayor of the above named body is hereby authorized to execute an agreement and any amendment thereto with the County; and

2.  That the applicant has its share of the project, if a match is required, in the amount of $256,000; and

3.  That, in the event the County funds are less than the total project cost specified above, the applicant has the balance of funding necessary to complete the project; and

4.  The applicant agrees to comply with all applicable federal, state, and local laws, rules, and regulations in its performance of the project; and

5.  That this resolution shall take effect immediately.
