Title: In the Matter of the Appeal of a Disciplinary Action against William Haffler

WHEREAS, an appeal of the decision of the Administrator was made to the Governing Body of the Borough of Hillsdale; and

WHEREAS, hearings were held on August 14, 2007 and October 29, 2007; and

WHEREAS, all the evidence has been reviewed and the Council has had an opportunity to deliberate;

NOW, THEREFORE, BE IT RESOLVED, by the Governing Body of the Borough of Hillsdale, County of Bergen and State of New Jersey, as follows:

The determination of the Borough Administrator dated June 4, 2007 be and is hereby affirmed subject to additional terms and conditions to be placed in the personnel file of William Haffler in order to preserve the privacy rights of Mr. Haffler, who has requested that this matter be heard in private and not open to the public.

BE IT FURTHER RESOLVED that a copy of this Resolution be forwarded to the Administrator of the Borough.

RESOLUTION

Title: In the Matter of the Appeal of a Disciplinary Action against William Haffler

WHEREAS, a Resolution is to be adopted this evening affirming the decision of the Administrator; and

WHEREAS, the Governing Body has adopted certain conditions to any future application to the Hillsdale Fire Department by William Haffler;

NOW, THEREFORE, BE IT RESOLVED, by the Governing Body of the Borough of Hillsdale, County of Bergen and State of New Jersey, as follows:

The following conditions will apply to any future application by Mr. Haffler for membership in the Hillsdale Fire Department:

A. William Haffler may not reapply for membership in the Hillsdale Fire Department for two (2) years from the date that the Bergen County Central Municipal Court confirms that Mr. Haffler has completed the community service as agreed to by him in a certain plea arrangement regarding Complaint No. 2006-000065.

B. Prior to considerations for his reapplication to the Board of Fire Officers, Mr. Haffler will be involved in an alcohol rehabilitation program similar to Alcoholics Anonymous and, he shall provide proof of his successful involvement.

C. Mr. Haffler is prohibited from imbibing any alcohol prior to or at any social function of the Hillsdale Fire Department.

BE IT FURTHER RESOLVED that a copy of this Resolution be forwarded to the Administrator of the Borough.
