Title: Settling
Salary Dispute with Stonybrook Employee
WHEREAS, the Stonybroo9k Swim Club Commission has advised the
Borough Council that one of its employees, Patty Hughes, Swim Club Manager, was
not paid the amount of salary approved by them for services prior to December
31, 2007; and
WHEREAS, a review of the minutes of
their meetings shows that the Commission did in fact authorize a higher salary to be paid to this employee than
was actually paid; and
WHEREAS, the Borough Attorney,
Elizabeth Randall, Esq., has reviewed the related documents and, in her
opinion, the Commission had the authority to set the Manager’s salary at the
amount it did since it was within the range set by Borough Ordinance and
adequate funds were provided in the utilities budget; and
WHEREAS, the Borough Council wishes
to resolve this issue in a manner that conforms with the law and is fair to the
Borough and the employee; and
WHEREAS, the Borough Council and the
Stonybrook Swim Club Commission have agreed that a payment of $8,067.00 for
services performed by the Swim Club Manager prior to December 31, 2007 will
resolve this issue fairly; and
WHEREAS, Stonybrook’s 2008 salary appropriations
are adequate to cover this cost, plus the 3% increase approved for Officials
and Managers in 2008.
NOW, THEREFORE, BE IT
RESOLVED, that, if the proposed payment is acceptable to
the employee, a payment of $8,067.00 is authorized to be made by the CFO to
Patty Hughes to resolve all past salary underpayments.
