RESOLUTION

Title: Hold Harmless Agreement with the Board of Education

 

WHEREAS, the Borough of Hillsdale desires to use the school building, school grounds, playfields and other facilities and property at the George G. White, Ann Blanche Smith and Meadowbrook Schools for recreation programs and excess parking for the Stonybrook Swim Club; and

 

WHEREAS, the Board of Education of the Borough of Hillsdale agrees that such use is both necessary and desirable, provided that the Board of Education be held harmless of any and all liability arising out of the use of said school buildings, grounds and playfields and other facilities and property;

 

NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council be and are hereby authorized to execute a hold harmless agreement running from the Borough of Hillsdale to the Board of Education of the Borough of Hillsdale for the period September 1, 2009 to August 31, 2010, whereby the Borough agrees to save and hold harmless the Board, its agents, servants and administrators from any and all liability arising out of the use of said school buildings, grounds, playfields and other facilities and property.

HOLD HARMLESS AGREEMENT

 

 

            For and in consideration of the use of the school buildings, school grounds, playfields, and other facilities and property at the George G. White, Ann Blanche Smith and Meadowbrook Schools in the Borough of Hillsdale, from September 1, 2009 to August 31, 2010, by the Borough of Hillsdale, a Municipal Corporation in the County of Bergen and State of New Jersey, and the Recreation Commission of the said Borough of Hillsdale, the said borough of Hillsdale covenants and agrees to save and hold harmless the Board of Education of the Borough of Hillsdale in the County of Bergen, its agents, servants and administrators from any and all liability arising out of the use of said school buildings, school grounds, playfields, and other facilities and property.
