RESOLUTION

Title: Authorizing New Cingular Wireless to Proceed with Fulfilment of Contract Specifications

WHEREAS, the Borough of Hillsdale currently leases a telecommunication tower and ancillary ground space at its premises known as 383 Hillsdale Avenue on Block 1309, Lot 12; and

WHEREAS, the Borough received bids for co-location of additional facilities on that site on June 19, 2008; and

WHEREAS, pursuant to the public bid, the highest responsible bidder was New Cingular Wireless Pcs, LLC, 15 East Midland Avenue, Paramus, New Jersey; and

WHEREAS, the Borough awarded the contract for the placement of wireless telecommunication antennas and upon approval as to the form of the contract by the Borough Attorney; and

WHEREAS, the form of contract has been reviewed and approved by the Borough Attorney; and

WHEREAS, the Contract is contingent upon application to, and approval of, the Borough of Hillsdale Planning Board for the placement of the antenna and associated ancillary ground equipment related to the support of the facilities; and

NOW, THEREFORE, BE IT RESOLVED, by the Governing Body of the Borough of Hillsdale that New Cingular Wireless, PCS, LLC is hereby authorized in its capacity as a contract tenant of the Borough, to make application before the Borough Planning Board in accordance with the specifications of the bid award.
